Introduction
Welcome to Washington Area Tennis Association ("WATA Tennis," "WATA," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, league registration systems, tennis and pickleball leagues, and related services (collectively, the "Services").
By registering for a league, using our website, or participating in any WATA Tennis programs, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services or participate in our leagues.
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, INCLUDING LIMITATIONS ON LIABILITY AND A WAIVER OF CERTAIN LEGAL RIGHTS.
WATA Tennis League Updates
1. Eligibility and Registration
Age Requirement
You must be at least 18 years of age to register for and participate in WATA Tennis leagues. By registering, you represent and warrant that you are 18 years or older and have the legal capacity to enter into these Terms.
Account Registration
To participate in our leagues, you must provide accurate, current, and complete information during registration, including:
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Skill Level Accuracy
You agree to provide an accurate representation of your tennis or pickleball skill level. WATA Tennis reserves the right to verify your skill level through your World Tennis Number (WTN) or other means and to reassign you to an appropriate league division if necessary. Intentionally misrepresenting your skill level may result in removal from the league without refund.
2. League Participation
"Everyone Plays" Philosophy
WATA Tennis operates under an "Everyone Plays" philosophy, which means all registered participants are guaranteed court time during each league session. Unlike traditional USTA leagues where players may be benched, we ensure that every participant has the opportunity to play.
League Schedule and Attendance
By registering for a league, you commit to participating in the scheduled sessions at the designated facility and time. League schedules, locations, and start dates will be communicated to you upon registration and may include:
We understand that scheduling conflicts may arise. If you are unable to attend a session, please notify us as soon as possible. Repeated absences without notice may affect your eligibility for future leagues.
Match Play and Conduct
All participants are expected to:
WATA Tennis reserves the right to remove any participant who engages in unsportsmanlike conduct, harassment, or behavior that disrupts the league experience for others. No refund will be provided in such cases.
3. Fees and Payments
League Fees
League fees are due at the time of registration. Payment must be made in full before your registration is confirmed. Fees vary by league, location, and season. All fees are clearly stated during the registration process.
Payment Methods
We accept payment via credit card, debit card, and other payment methods as indicated during registration. By providing payment information, you authorize us to charge the applicable fees to your payment method.
Refund Policy
Refunds are handled as follows:
WATA Tennis reserves the right to cancel a league due to insufficient enrollment or unforeseen circumstances. In such cases, participants will receive a full refund.
4. Liability Waiver and Assumption of Risk
Participation in tennis and pickleball activities involves inherent risks, including but not limited to physical injury, property damage, and other hazards. By participating in WATA Tennis leagues, you acknowledge and accept these risks.

You understand and acknowledge that participating in tennis and pickleball activities may result in:
You voluntarily assume all risks associated with participation in WATA Tennis leagues and activities.
Release of Liability
To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue WATA Tennis, its officers, employees, agents, facility partners, and affiliates (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by you while participating in WATA Tennis leagues or activities, whether caused by the negligence of the Released Parties or otherwise.
Medical Condition
You represent that you are in good physical condition and have no medical conditions that would prevent you from safely participating in tennis or pickleball activities. You agree to consult with a physician before participating if you have any concerns about your physical ability to participate safely.
Insurance
You acknowledge that WATA Tennis does not provide health, accident, or liability insurance for participants. You are responsible for obtaining adequate insurance coverage for yourself.
5. Facility Use and Rules
WATA Tennis leagues are conducted at various partner facilities. When participating in league activities, you agree to:
You may be held responsible for any damage to facility property caused by your actions or negligence. Violation of facility rules may result in removal from the league without refund.
6. Intellectual Property
All content on the WATA Tennis website and materials, including text, graphics, logos, images, and software, is the property of WATA Tennis or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.
7. Privacy
Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
8. Communications and Marketing
By registering for WATA Tennis leagues, you agree to receive communications from us via email, SMS text message, and phone regarding:

9. Modification of Terms and Services
WATA Tennis reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new "Last Updated" date. Your continued use of our Services after such changes constitutes your acceptance of the modified Terms.
We also reserve the right to modify, suspend, or discontinue any aspect of our Services, including league schedules, locations, or formats, at any time. We will make reasonable efforts to provide advance notice of significant changes.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WATA TENNIS AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
IN NO EVENT SHALL WATA TENNIS'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO WATA TENNIS FOR LEAGUE REGISTRATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless WATA Tennis and its officers, employees, agents, facility partners, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

Informal Resolution
If you have a dispute with WATA Tennis, you agree to first contact us at info@watatennisdc.com to attempt to resolve the dispute informally. We will work in good faith to resolve any issues.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the District of Columbia and the State of Maryland, without regard to conflict of law principles.
Venue
Any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the state or federal courts located in Washington, DC or Montgomery County, Maryland, and you consent to the jurisdiction of such courts.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WATA Tennis regarding your use of the Services and supersede all prior agreements, understandings, and communications, whether written or oral.
15. Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
16. Assignment
You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. WATA Tennis may assign or transfer these Terms without restriction.
